Presumptive Conditions (Diseases/Disabilities)

Congress, compelled by Veterans and overwhelming medical evidence has passed laws that concede service-connection to certain eligible Veterans who served during certain periods of time, locations, or whose conditions developed within a certain time period after separation from service.

Which means that Veterans who meet all of the eligibility requirements and have a diagnosed condition, disease, or disability will receive service-connection. This entitles the Veteran to Disability compensationMedical treatment, and Other benefits.

IMPORTANT NOTES:

  • The Veteran's character of discharge must allow them to file a claim for disability compensation.

  • The Veteran's disability must manifest to a at least a 10% degree of disability unless stated otherwise.

  • If a Veteran had a disability while in service or their current disability may have been the result of a service-connected disability and the Veteran is outside of the listed time frames the Veteran may still receive service-connection through the normal process of establishing an in-service event and nexus to a diagnosed condition.

  • To summarize what presumptive conditions, diseases, or disabilities are: the Veteran may not have the issue(s) while in service and the issue might be unrelated to other service-connected disabilities. However, due to the Veteran's eligibility, it has been determined that said issue is as likely as not due to the Veteran's service. As such, the Veteran is granted presumptive service-connection.
